ENOUGH IS ENOUGH
If the government breaks the law, you can too.
The playing field has to be leveled somehow, doesn't it?
If Tyler Thomas and his attorney can falsify evidence, submit it in a court of law, hob-nob secretly with the DEC while the DEC "helps" them with a case against an animal owner from whom Thomas stole valuable exotic animals, then we can be licensed! As one can easily notice, the licensing systems currently in place for exotic and wild animals do not protect against unlawful possession and treatment of animals since the authorities in charge of the licensing systems are the ones breaking the laws related to possession and treatment of animals. * * * * * * * * * If agencies like the DEC and USDA violate constitutional rights, such as due process, during hearings and run kangaroo courts, then their decisions should be treated with the same quality inherent in the agencies' treatment of certain licensees.
Besides, regulations and rules are edicts, not laws! Few are courageous enough to stand up to the DEC although a brave soul was found in Mr. James McCulley and his attorney, Matthew Norfolk of Lake Placid. Read about how the DEC put Mr. McCulley through fifteen years of litigation easily spending at least $250,000 of taxpayer money over litigation concerning an alleged violation causing the issuance of a $50 ticket they gave McCulley! Mr McCulley fought and won!!! |
If Kim Cassidy is allowed to take RVS species inside her house without an RVS license and allow them to live among her pets and children, rehabilitate other species among them inside her house because she has no outside enclosures and keep a number of animals permanently and then GIVEN ONLY ONE CITATION after numerous complaints had been filed with the DEC Law Enforcement Dispatch about Cassidy, then we can still be licensed to rehabilitate wildlife!

Miss "Goody 2-Shoes" Michelle Mills has appointed herself as "oversee-er" of licensing compliance in the Rochester-area; well, except for herself, that is. She enjoys being in possession of birds protected by the Migratory Bird Treaty Act then tattling on others for doing nothing wrong. She goes out of her way as "protector" and with an ego to boot! If this person can elevate herself to "supervisor" of licensees, then we can be licensed and rehabilitate animals!

Oh, yes and lie about the Public Officer's Law and refuse to properly process FOIL requests, then we don't have to recognize the laws we don't want to either. * * * * * * * * NONE OF THESE PEOPLE LOST THEIR LICENSES NOR DID MOST OF THEM EVER EVEN GET A VISIT FROM MR. POWELL AND HIS OFFICERS FROM THE DEC BECAUSE HE SELECTIVELY ENFORCES AND MISREPRESENTS LAWS. SO NOW IT'S TIME TO DO THE SAME THING AND DO WHAT WE WANT! NO MORE ! * * * * * * * * * * * * During our reading over case papers over the last five years concerning the administrative state and animal licensing systems, we have noticed several attorneys representing others in our exact position where their clients were following the law but the DEC and USDA were using the law against them for political and/or personal reasons. The attorneys, as frustrated as their clients, basically stated they told their clients they didn't have to follow the law any more than the agencies do .It's considered CIVILIAN DISOBEDIENCE. |
If DEC officers and their boss, William Powell. can divulge details of "investigations" to members of the public, make derogatory remarks about someone and lie about them and their activities, including falsifying evidence, then we can be licensed to rehabilitate animals AND maintain long-term possession of wild and exotic animals.* * * * * * * If Kris Forsythe-King can keep seven red-tailed hawks in a small horse stall for years with only a small window from which they may look up at the skies they are meant to fly in, keep Eastern Screech Owls for an illegal breeding program, have an unlicensed raccoon for over 13 years, keep rehab patients in a dungeon at the bottom of her barn where scores died in one season in the not-so-distant past and give baby cottontails only one quick chance to quick suck from a syringe for its only meal of the day, then guess what?

We, here at Caring for Cottontails, have been strict about following the law and licensing provisions over the years and anyone saying anything to the contrary by the DEC and their flying monkeys are, to say it as nicely as we can, "full of it."
Just because our Director spoke up during a phone call with Lieutenant Powell of DEC R8 Law Enforcement and challenged him when he got angry when she asked him to ask his officers to leave a business card or write down their names if they visit our facility in her absence, he threatened her licenses and targeted her ever since. She was entrapped as he told her everything was fine with her facility then turned around, responding to an obviously false complaint (by my 800-lb. neighbor who has his own issues) and without investigation and without any warning at all, came and took a beautiful pack of healthy coyotes and kept them in the office at the Region 8 headquarters building in Avon, without food and water then had them euthanized and then went around and told everyone they were starved.
He worked with Jami Hammer of Indiana Coyote Rescue Center to start gossip and false statements about the coyotes just to make our Director look bad! Boy, with "advocates" like Powell and his side-kick Hammer in Indiana, these animals don't need any enemies, do they?
Be very careful who you believe! Just because there is an appearance of more people on one side of the scenario than the other, doesn't mean the "more populous" side is the side in the right. Keep in mind bullying usually happens when there are many people on one side and only one loner on the other, yet we all know the bullies are wrong!
This is what the DEC and USDA are - bullies who take advantage of all of those who are gullible enough to believe their BS and not the side of their fellow licensees. ALWAYS support your colleagues and ALWAYS consider all that's said and done by the authorities as likely suspect. There's a reason why authorities will tell people details of what they call an "investigation" which is pending or accuse a person of animal neglect, cruelty or hoarding always behind the backs of the people they are accusing (courageous people aren't they?) yet the same authority figures have no evidence whatsoever, including their failure to charge the target for such crimes. ...... and no pictures or video on record or used in a hearing or town proceeding or anything. These are inflammatory statements made against someone simply because the officers didn't have enough evidence to tell the truth AND because they want to ruin the person's reputation and thus their community service of rehabilitating animals and any other animal-related business he or she may have.
Everyone needs to learn to question authority instead of siding with them right off the bat so they can get free animals in return. We have tried every avenue to get along and mediate existing contentions with these authorities and have filed at least forty complaints between the two agencies, DEC and USDA, yet not one was taken seriously nor given a good-faith investigation.
We've tried the judicial system and the legislature and learn that both are controlled by the DEC and USDA, usually by discrediting challengers by gossiping like little old ladies and passing around derogatory remarks which aren't true.
The only two things left are either
1. resort to violence; or
2. take the liberties so many others have taken and "follow" the laws like everyone else, especially in the way the authorities and their favs do.
Because we don't believe in violence, we are doing the latter. We've given up after over five years of trying to resolve contentions in the mature and professional way only to find the system is so damaged that it just doesn't work.
There's something seriously wrong with a system when 40+ complaints and evidence which support our claims, are immediately dismissed, or ignored. It's time to be truly free and mimic the way the authorities and their monkeys follow the laws. We've never felt so much freedom and feel so carefree - breaking the law is really allowing us to experience the passion for wildlife like we had in the past. If anyone is going through similar things, please feel free to contact us and if you are one of the monkeys trying to entrap us or get "evidence" of us rehabbing or doing whatever we supposedly aren't supposed to do, have at it! We are not hiding anything!!!!
